W8BEN Form: PDF & Foreign Individual Tax Status Guide

This W8BEN Form guide explains the IRS Certificate of Foreign Status of Beneficial Owner for United States Tax Withholding and Reporting (Individuals). Form W-8BEN documents the foreign individual status and any properly supported treaty claim described by the form. It is not the standard certificate for a foreign entity. Providing a certificate to a withholding agent is different from filing an individual income tax return with the IRS.

What W8BEN Form does and who prepares it

A foreign individual provides the certificate to the withholding agent or payer when the applicable rules call for it.

For the connected reporting route, see Form W-8BEN-E. Keep the role of that document separate from the task explained on this page.

Which version of W8BEN Form should you use?

This form follows a revision or continuing-use format rather than a new title for every calendar year. Check the revision printed on the document and the period requested inside it. A revision date, transaction date and tax year are different pieces of information. The current document should be read with the instructions that apply to the actual transaction or return.

Records to gather for W8BEN Form

  • Individual identity and residence information.
  • Taxpayer identification where required.
  • Treaty-claim support when applicable.
  • Account or payment details.
  • Payer instructions.

Keep a working reconciliation with these records. It should show the source of each reported item, any correction made before filing and the reason a different amount appears on a connected form. This is especially useful when a statement is corrected or a prior-year balance continues into the current calculation.

How to work through W8BEN Form

  1. Choose the right certificate. Confirm that this is the certificate for the person, entity and payment type involved. Similar form numbers can have materially different purposes.
  2. Use accurate identification. Match the requested legal name, tax identification and status information with the supporting records. Do not guess a classification from an account nickname.
  3. Complete only supported elections. Read any applicable election, exemption or treaty conditions before claiming a result. A signature certifies facts; it does not create missing eligibility.
  4. Give the final form to the correct requester. Follow the payer or employer submission process. Do not treat every tax certificate as an income tax return that should be sent directly to the IRS.
  5. Keep a copy and review changes. Retain the submitted certificate and check whether a change in circumstances requires a new one. For withholding choices, compare later payment records with the requested change.

Additional reporting conditions

Establishing status for chapter 4 purposes. A foreign financial institution (FFI) may rely on a properly completed Form W-8BEN to establish your chapter 4 status as a foreign person. The Form W-8BEN should be provided to the FFI when requested. Failure to do so could result in 30% withholding on income paid or credited to you as a recalcitrant account holder from sources within the United States. See the definition of Amounts subject to withholding, later. Additional information. For additional information and for the Requester of Forms W-8BEN, W-8BEN-E, W-8ECI, W-8EXP, and W-8IMY.

Calculations and supporting information

Giving Form W-8BEN to the withholding agent. Do not send Form W-8BEN to the IRS. Instead, give it to the person who is requesting it from you. Generally, this will be the person from whom you receive the payment, who credits your account, or a partnership that allocates income to you. An FFI may also request this form from you to document your account as other than a U.S. account. Give Form W-8BEN to the person requesting it before the payment is made to you, credited to your account, or allocated.

If you do not provide this form, the withholding agent may have to withhold at the 30% rate (under chapters 3 and 4), backup withholding rate, or the rate applicable under section 1446. If you receive more than one type of income from a single withholding agent for which you claim different benefits, the withholding agent may, at its option, require you to submit a Form W-8BEN for each different type of income. Generally, a separate Form W-8BEN must be given to each withholding agent.

A practical example

A foreign individual receives a request from a U.S. payer for tax status documentation. The individual checks the correct form, completes the supported residence and treaty information and gives the certificate to the requester through a secure process.

This example illustrates the order of the review. It does not assume an unverified deduction, exemption, treaty rate or final tax amount. The applicable form instructions and the actual records determine the result.

Common mistakes to avoid with W8BEN Form

  • Do not use the individual certificate for an entity.
  • A treaty claim requires the relevant eligibility facts.
  • Check when changed circumstances require a new certificate.

Questions about W8BEN Form

Does receiving or downloading this form mean I must file it?

A foreign individual provides the certificate to the withholding agent or payer when the applicable rules call for it. The form purpose and the applicable filing or furnishing conditions determine the action. Downloading a blank PDF does not itself create a filing obligation or establish eligibility for a tax benefit.

Is the revision date always the same as the tax year?

No. Some forms show a tax year, while continuing-use forms show a revision date and ask separately for the reporting period. Check the actual document and instructions. Do not relabel a payment or transaction solely because it was reported in a later calendar year.

What should I do if the underlying information is wrong?

Do not use the individual certificate for an entity. Keep the original record and the correction trail. The issuer correction process, an amended return and an updated certificate can be different procedures. Choose the process that matches the document and the actual error.

Which records should I keep with the completed form?

Retain the source documents, applicable worksheets, submitted version and filing or furnishing confirmations. For this form, the working file should include individual identity and residence information, taxpayer identification where required, treaty-claim support when applicable. Keep continuing balances and prior-year support for as long as they remain relevant under the applicable recordkeeping rules.
